Introduction
These Terms and Conditions ("Terms") govern your use of the EAC Painting Pte Ltd website and the provision of our painting and maintenance services. By accessing our website or engaging our services, you agree to be bound by these Terms.
EAC Painting Pte Ltd ("we," "our," or "us") is a company registered in Singapore, specializing in high-rise exterior painting, building facade cleaning, waterproofing, interior painting, and related maintenance services.
If you do not agree with these Terms, please do not use our website or services.
Definitions
"Client" or "You" refers to the individual or entity engaging our services. "Services" refers to all painting, cleaning, waterproofing, maintenance, and related work provided by EAC Painting. "Site" refers to the property location where services are to be performed. "Quotation" refers to our written estimate for services. "Agreement" refers to the binding contract formed upon acceptance of our quotation.
Services Offered
EAC Painting provides the following services:
High-rise exterior painting using rope access, gondola, boom lift, and scissors lift Building facade cleaning and pressure washing Waterproofing for roofs, walls, bathrooms, and basements Interior painting and finishing Patching, plastering, and surface repairs Anti-corrosion coatings Color consultation services Integrated maintenance packages
All services are subject to site assessment and feasibility evaluation.
Quotations and Pricing
4.1 Quotation Validity
All quotations are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change after the validity period. Quotations are based on information provided by the client and site inspection findings.
4.2 Quotation Adjustments
We reserve the right to adjust quotations if: Site conditions differ materially from initial assessment Additional work is required beyond the original scope Material costs increase significantly Access methods need to be changed due to unforeseen circumstances Weather conditions or regulatory requirements necessitate changes
4.3 What's Included
Our quotations typically include: Labor and supervision costs Materials (paint, primers, sealants, waterproofing membranes) Access equipment rental (rope access, gondola, lifts) Safety equipment and compliance measures Site cleanup and waste disposal Warranty as specified in the quotation
4.4 What's Not Included
Unless specifically stated, quotations do not include: Repair of major structural defects Removal or disposal of hazardous materials (e.g., asbestos) Electrical or plumbing work Furniture moving or storage Parking permits or special access permits Additional work requested after project commencement
Booking and Deposits
5.1 Acceptance of Quotation
Services are booked upon: Written acceptance of our quotation (email or signed document) Payment of the required deposit Confirmation of project start date
5.2 Deposit Requirements
Residential projects: 30-50% deposit upon booking Commercial projects: 30-40% deposit upon booking Large-scale projects: Payment schedule as agreed in contract
5.3 Deposit Terms
Deposits are non-refundable except in cases of cancellation by EAC Painting Deposits secure your project slot and cover initial material procurement If project is postponed by client, deposit remains valid for 90 days
Payment Terms
6.1 Payment Schedule
Small projects (under SGD 5,000): 50% deposit, 50% upon completion Medium projects (SGD 5,000-20,000): 30% deposit, 40% mid-project, 30% upon completion Large projects (over SGD 20,000): Payment milestones as specified in contract
6.2 Payment Methods
Bank transfer Cheque (subject to clearance) PayNow Cash (for amounts under SGD 5,000) Credit/Debit card (may incur processing fee)
6.3 Late Payment
Invoices are due within 14 days of issue unless otherwise agreed Late payments may incur interest at 1.5% per month Work may be suspended if payment is overdue by more than 30 days Legal action may be taken to recover outstanding debts
6.4 Final Payment
Final payment is due upon completion and client inspection Completion is deemed when work is finished per agreed specifications Minor touch-ups identified during final inspection will be completed within 7 days
Project Timeline
7.1 Start Date
Project start dates are estimates and subject to: Weather conditions Material availability Access equipment availability Regulatory approvals
7.2 Completion Timeline
Estimated completion dates are provided in good faith We will make reasonable efforts to complete work within agreed timeframes Delays beyond our control (weather, permit delays, client-caused delays) extend completion date accordingly
7.3 Weather-Related Delays
Exterior painting and waterproofing are weather-dependent Work may be suspended during rain, extreme heat, or high winds No compensation is provided for weather delays Project timeline extends automatically for weather delay days
Client Responsibilities
8.1 Site Access
Provide safe, clear, and continuous access to work areas Ensure availability of water and electricity connections Provide parking or unloading areas for equipment and materials Notify us of any access restrictions or special requirements
8.2 Site Preparation
Remove or protect furniture, plants, and valuable items Secure pets during work hours Inform us of any hazardous materials or conditions Clear work areas of obstacles
8.3 Approvals and Permits
Obtain necessary approvals from building management or MCST Inform neighbors about scheduled work (for residential projects) Provide any required permits or licenses Notify us of any building restrictions or regulations
8.4 Communication
Designate a primary contact person for project communication Respond promptly to requests for decisions or clarifications Conduct site inspections as scheduled Report concerns immediately rather than at project end
Our Responsibilities
9.1 Workmanship
Provide services in a professional and workmanlike manner Use qualified, trained, and IRATA-certified personnel where required Follow industry best practices and safety standards Comply with BCA regulations and Singapore building codes
9.2 Materials
Use high-quality materials from reputable brands (Nippon Paint, Jotun, Sika, etc.) Ensure materials are appropriate for Singapore's tropical climate Store materials properly on site Provide material safety data sheets upon request
9.3 Safety
Conduct risk assessments before commencing work Implement appropriate safety measures and protocols Maintain comprehensive insurance coverage Use certified access equipment and safety gear Train staff on safety procedures
9.4 Site Management
Minimize disruption to occupants and neighbors Maintain clean and organized work areas Dispose of waste responsibly and legally Restore site to original condition (excluding painted surfaces)
. Warranties
10.1 Workmanship Warranty
We provide a warranty period of 1-3 years on workmanship (as specified in quotation) Warranty covers defects arising from improper application or workmanship errors Warranty does not cover normal wear and tear, damage from misuse, or unauthorized repairs
10.2 Material Warranty
Material warranties are provided by manufacturers We will assist in processing manufacturer warranty claims Typical material warranties: 3-5 years for paints, 5-10 years for waterproofing
10.3 Warranty Exclusions
Warranties do not cover: Damage from accidents, abuse, or improper maintenance Failures due to structural defects or movements Damage from extreme weather events (typhoons, floods) Work performed by third parties Areas not maintained according to our care instructions Normal fading or wear from environmental exposure
10.4 Warranty Claims
Report defects in writing within warranty period Allow us reasonable time to inspect and remedy defects Warranty repairs will be completed during normal business hours We reserve the right to determine appropriate remedy method
. Variations and Additional Work
11.1 Requesting Changes
All variation requests must be submitted in writing We will provide written quotation for additional work Work begins only after client approval and payment terms agreed
11.2 Additional Costs
Changes to project scope may result in additional charges Additional work discovered during project will be quoted separately Client must approve additional costs before work proceeds
11.3 Timeline Impact
Variations may extend project completion timeline Timeline extensions will be communicated in writing
. Cancellation and Postponement
12.1 Cancellation by Client
Cancellation must be made in writing Cancellation before work commencement: Deposit forfeited Cancellation after work begins: Payment due for work completed plus 30% of remaining contract value Materials already purchased are non-refundable
12.2 Postponement by Client
First postponement: No charge if made at least 7 days before start date Subsequent postponements: SGD 200 administrative fee Project must recommence within 90 days or deposit is forfeited New pricing may apply if materials costs have increased
12.3 Cancellation by EAC Painting
We may cancel if: Site conditions are unsafe or unsuitable Client breaches payment terms Required permits cannot be obtained Client provides false or misleading information
If we cancel, all deposits will be refunded
. Liability and Insurance
13.1 Our Insurance
We maintain comprehensive public liability insurance We maintain workers' compensation insurance for all employees Certificate of insurance available upon request
13.2 Liability Limitations
Our liability is limited to the contract value for the specific project We are not liable for consequential or indirect losses We are not liable for damage to defective surfaces or structures We are not liable for delays beyond our reasonable control
13.3 Property Damage
We take reasonable care to protect client property Client should remove or protect valuable items before work begins We are liable for damage caused by our negligence Claims must be reported within 7 days of discovery
13.4 Third Party Claims
We are not responsible for claims from neighbors or third parties Client must obtain necessary approvals from building management/MCST Client indemnifies us against claims arising from lack of proper approvals
. Intellectual Property
14.1 Color Schemes and Designs
Custom color schemes and design recommendations remain our intellectual property Clients may use designs for the specific contracted project only Designs may not be shared with competitors or used for other projects
14.2 Marketing and Testimonials
We may photograph completed projects for marketing purposes Client consent will be obtained before using project photos Client may request anonymity in case studies and testimonials
. Force Majeure
We are not liable for delays or failures due to: Natural disasters, extreme weather, or acts of God Pandemics, epidemics, or public health emergencies Government restrictions or regulatory changes Labor disputes, strikes, or lockouts Material shortages or supply chain disruptions War, terrorism, or civil unrest
In such events, project timelines extend automatically without penalty.
. Dispute Resolution
16.1 Informal Resolution
Disputes should first be raised in writing to our management We will respond within 7 business days We will attempt to resolve disputes amicably through negotiation
16.2 Mediation
If informal resolution fails, parties agree to attempt mediation Mediation costs to be shared equally Singapore Mediation Centre procedures apply
16.3 Legal Action
If mediation fails, disputes may be brought to Singapore courts These Terms are governed by Singapore law Each party bears their own legal costs unless court orders otherwise
. Complaints and Feedback
17.1 Making a Complaint
Complaints should be submitted in writing to: info@eacpainting.com.sg Include project details, nature of complaint, and supporting evidence We will acknowledge receipt within 2 business days We will investigate and respond within 14 business days
17.2 Escalation
If unsatisfied with initial response, request escalation to management Final decisions will be made by company directors
. Data Protection and Privacy
Your personal data is protected under our Privacy Policy We collect and use data only for service delivery and legal compliance Data is not shared with third parties except as required by law Full details available in our Privacy Policy
. Subcontractors
We may engage qualified subcontractors for specialized work All subcontractors are vetted and insured We remain fully responsible for subcontractor work quality Subcontractors must comply with all terms and safety requirements
. Health and Safety
20.1 Client Cooperation
Clients must inform us of any health conditions affecting workers (e.g., allergies) Clients must notify us of hazardous materials on site Clients must keep children and pets away from work areas
20.2 Our Commitment
We maintain zero-incident safety record as our goal All staff receive regular safety training We comply with WSH (Workplace Safety and Health) Act IRATA-certified technicians for all rope access work
. Environmental Responsibility
We use low-VOC and environmentally friendly paints where possible We dispose of waste materials according to NEA regulations We minimize material waste through careful planning We support sustainable practices throughout our operations
. General Provisions
22.1 Entire Agreement
These Terms, together with the quotation and any written variations, constitute the entire agreement Verbal agreements or representations are not binding unless confirmed in writing
22.2 Severability
If any provision is found invalid, remaining provisions continue in effect
22.3 Waiver
Failure to enforce any right does not constitute waiver of that right
22.4 Assignment
Clients may not assign or transfer obligations without our written consent We may assign or subcontract work as necessary
22.5 Notices
All notices must be in writing Email notices are acceptable and deemed received within 24 hours Postal notices deemed received within 3 business days
22.6 Amendment
We reserve the right to update these Terms at any time Changes effective upon posting to website Existing contracts governed by Terms in effect at booking time
